Farmer Jaffe Weissing sexual abuse attorney Adam Horowitz filed a lawsuit this week on behalf of a female client of Massage Envy who alleges that she was sexually assaulted by a male massage therapist. The lawsuit, filed in Palm Beach County Circuit Court, accuses Raymond Smith, Jr. of rubbing the victim’s vagina toward the end of a 90-minute massage in December 2014. The incident reportedly occurred at the Massage Envy franchise located at 7050 West Palm Park Road in Boca Raton, Florida. The massage therapist is also accused of making lewd comments about her appearance. This Massage Envy franchise is owned by CB INVESTMENTS LLC d/b/a MASSAGE ENVY.
Following the assault, the alleged victim reported her assault to the Boca Raton police department who in turn forwarded the complaint to the Palm Beach County State Attorney’s office. According to the police report, Raymond Smith, Jr. told law enforcement that what occurred was a “big accident.” Massage Envy later informed the alleged victim that Raymond Smith, Jr. was “taken off the schedule” according to the Complaint.
Farmer Jaffe Weissing has filed numerous lawsuits throughout the United States involving unwanted sexual contact initiated by massage therapists on unsuspecting female clients. One such recent case involved a massage envy employee Michael Ster who was convicted by a Broward County jury and is facing a 30-year prison sentence.
Massage Envy franchises throughout the country have come under fire because of what appears to be a high rate of incident of sexual assault involving male massage therapist on female clients. Within the past year alone there have been assaults reported in Houston, Los Angeles, Phoenix, Northwest Arkansas, Thousand Oaks among many other locations. In some instances, massage therapists accused of assault at one location wound up working at another franchise location in the same state and assaulted another client. In civil lawsuits, the Massage Envy franchisor has been accused of establishing inadequate policies and procedure to prevent incidents of sexual assault. For instance, one policy manual instructs franchise owners facing sexual assault charges on how to “protect your investment” and “avoid negative impact on the Massage Envy Spa brand.” In some instances, franchise owners were not directed to report the incident to law enforcement.
Attorney Adam Horowitz stated, “This is the latest in a disturbing trend of cases in which male massage therapist are allegedly assaulting their vulnerable female clients. Women who come to receive massage come for relaxation and are increasingly becoming the prey of their massage therapists.”
