Farmer Jaffe Weissing sexual abuse attorney Adam Horowitz has filed yet another lawsuit sexual abuse against a Massage Envy franchise accusing a massage therapist of sexually assaulting a female client. The most recent case was filed September 18, 20105 in Orlando, Florida against Massage Envy Spa Winter Garden (Orange County Circuit Court Case No. 2015-CA-008641-O). The lawsuit alleges battery of a female client by Massage Envy massage therapist, Cesar Guerrero. The civil Complaint alleges that the battery occurred during a massage on June 13, 2015, at a Massage Envy franchise located at 3025 Daniels Parkway, Winter Garden, Florida.
According to the lawsuit, the victim went to Massage Envy to obtain a sixty minute massage. She was assigned Guerrero to perform her massage. At the end of the massage, while the client was on her back, Guerrero allegedly placed his hands underneath the draping covering his client’s body. He then began rubbing her inner thigh and then moved his fingers inside of her vagina. The alleged victim initially froze in disbelief. Guerrero then allegedly stroked her genitals until she gained composure and managed to push him away from her genitals.
The victim alleges she was mortified and in shock when she exited Massage Envy. Shortly thereafter, the alleged victim reported this incident to the Winter Garden Police Department. As of the date of the filing of the lawsuit, this matter is an open criminal investigation. Guerrero is no longer employed at Massage Envy and according to public records is not practicing massage therapy in the State of Florida.
The lawsuit alleges that Massage Envy is aware that its massage therapists are committing assault upon female clients at extraordinary rates, but does little to warn or protect female clients of this danger.
Massage Envy’s manual states only that they “promise to investigate and take appropriate action.” Their “Inappropriate Touch Procedure” section of the manual lacks instructions for Massage Envy to notify law enforcement. These procedures foster an environment conducive to misconduct by its massage therapists who can commit battery misconduct without the risk that law enforcement will be notified by their employer and who are actually emboldened by their employer with the wisdom that most clients will never report their incidents of battery.
Adam Horowitz, attorney or the victim and who has represented numerous women who reported incidents of assault at various Massage Envy locations, stated: “Women who receive massages place great trust in their therapists. There are not many other situations in which a person would be semi-nude in a prone position in a dimly-lit room with a complete stranger. It is a horrific betrayal when someone goes to a massage for relaxation but gets exploitation. Unfortunately, the massage industry appears to attract an extraordinary number of predators.”
