Lawsuit Filed Against Massage Envy For Alleged Sexual Abuse by Orlando Massage Therapist

massage envy lawsuit sexualA lawsuit has been filed against a Massage Envy franchise in Orlando alleging that massage therapist Frederick Dost sexually assaulted a female client during a massage therapy appointment.  This lawsuit is just the latest in a long line of lawsuits filed by Farmer Jaffe Weissing sexual abuse attorney Adam Horowitz alleging similar sexual misconduct by male massage therapists on female clients at Massage Envy.  The most recent case was filed January 27, 2016 in Orlando, Florida against Copper Carma, Inc. d/b/a Massage Envy, a franchise located at 8081 Turkey Lake Road, Suite 100, Orlando, Florida.

According to the lawsuit, the alleged victim went to Massage Envy to obtain a two hour massage.  During the massage appointment, Dost did not properly drape the client as he exposed her breasts according to the Complaint. The alleged victim contends that Dost’s hands made skin-to-skin contact with her breasts and he groped her breasts.  Further, she states that he had his groin pressed against the top of her head.  The alleged victim had never experienced anything like this in a previous massage and was in shock and completely unprepared for Dost’s sexual contact.  She reported this incident to law enforcement, the Florida Department of Health, and the Massage Envy franchise.  Dost’s employment at Massage Envy was terminated.  Frederick Dost advertises massage therapy services in the Orlando area on his website, borntomassage.com.

The lawsuit alleges that Massage Envy is aware that its massage therapists are committing assault upon female clients at extraordinary rates, but does nothing to warn or protect female clients of this danger.  Massage Envy’s manual states only that they “promise to investigate and take appropriate action.”  Their “Inappropriate Touch Procedure” section of the manual lacks instructions for Massage Envy to notify law enforcement or the Department of Health.  These procedures foster an environment conducive to misconduct by its massage therapists who can commit battery misconduct without the risk that law enforcement will be notified by their employer and who are actually emboldened by their employer with the wisdom that most clients will never report their incidents of battery.

Adam Horowitz, the attorney for the alleged victim, has represented numerous women who reported incidents of assault at various Massage Envy locations. He stated: “Women who receive massages place great trust in their therapists. There are not many other situations in which a person would be undressed in a prone position in a dimly-lit room with a complete stranger. It is a horrific betrayal when someone goes to a massage for relaxation but gets exploitation. Unfortunately, the massage industry appears to attract an extraordinary number of predators.”
