Attorney Adam Horowitz has filed a ninth lawsuit for alleged sexual assault against Dr. Manuel Abreu who practiced in Delray Beach and Clearwater, Florida. The sheer number of alleged victims in these cases illustrate two important themes which we often see in sexual abuse cases we handle – one is that perpetrators of sex crimes often have multiple victims and are embolden with each victim they harm, and secondly, when one victim has the courage to come forward to publicly accuse their perpetrator, that gives strength for other crime victims to come forward and seek justice.

Jury Awards $24 Million to Husband of Pregnant Wife Killed in 2012 Riverside Hotel Cabana
Partners Brad Edwards and Gary M. Farmer, Jr. and Co-Counsel Daniel W. Cotter of The Maher Law Firm obtained a $24 million dollar verdict in a wrongful death suit against a Fort Lauderdale hotel for the death of a hotel guest. Alanna Demella, seven months pregnant at the time, was killed when a car traveled off of the road and into a poolside cabana she was occupying at the Riverside Hotel in Fort Lauderdale. Partner Gary Farmer has been appointed to The Florida Bar’s Code & Rules of Evidence Committee. The Committee does not strictly follow the procedure for amending rules as set forth in Judicial Administration Rule 2.140. Instead, the Committee’s primary focus is on proposed legislation; rule amendments are proposed only as a technical matter to ensure that the Supreme Court’s Rules of Evidence comport with the code, Chapter 90, Florida Statutes. Gary will serve in the role through 2018.

Firm Presents Cy Pres Award to Legal Aid
Attorney Seth Lehrman, attorney Steve Jaffe, and co-counsel Scott Owens of Scott D. Owens, PA, presented a cy pres award in the amount of $40,799.44 to the Legal Aid Service of Broward County, Inc. This award was from a consumer class action settlement with Main Street Acquisition Corp., a collection agency, which failed to maintain the registration required by Florida statute. This settlement was a first of its kind in the 11th Circuit, recovering substantial benefits for consumers under an unjust enrichment claim based on Florida’s registration requirement. Bar Patron Seriously Injured – Bar Management Knew of History of Criminal Activity
Attorneys Brad Edwards and Gabriel F. Zambrano obtained a $806,289.00 jury verdictfor a bar patron who was violently attacked and left unconscious at Prince’s Beach Bar in Hollywood, Florida. On October 17, 2012, patron Michael Barnes was attacked and seriously injured by assailants using pool cues while inside Prince’s Beach Bar. As a result of the attack, Mr. Barnes suffered severe and permanent injuries. Mr. Barnes alleged that he was attacked as a result of Prince’s Beach Bar’s failure to provide adequate security on their premises.

Appeals Court Rules in Favor of Crime Victims’ Rights in Jeffrey Epstein Case
In a landmark decision, the U.S. Court of Appeals for the Eleventh Circuit Court on April 18, 2014, ruled in favor of two crime victims represented by Farmer, Jaffe, Weissing, Edwards, Fistos & Lehrman Partner Brad Edwards and his co-counsel, Paul Cassell, Ronald N. Boyce Presidential Professor of Criminal Law – S.J. Quinney College of Law at the University of Utah. The ruling upheld the District Court which ordered the United States Attorney’s Office to provide the victims and their advocates the large volume of correspondence exchanged between Jeffrey Epstein and the Government that resulted in the government electing not to Federally prosecute Epstein for his many abuse crimes against children. In a major victory for consumers on March 13, 2014, the Florida Supreme Court approved an earlier en banc decision by the Fifth District Court of Appeal in the matter of State Farm Automobile Insurance Co. v. Curran regarding an auto accident with an underinsured motorist resulting in a breach of contract and denial of coverage dispute. Jury Awards $13 Million to Woman Injured in Plummeting Elevator Accident
Partner Brad Edwards received a $13 million verdict on August Brad Edwards 31, following a two week jury trial. Thirteen years ago, Janice Beasley (41 years old) was riding in an elevator that plunged several floors before crashing to an abrupt stop. Ms. Beasley sustained significant permanent injuries which have confined her to a wheelchair for nearly 13 years. The defendants sought to avoid responsibility for this accident, which Ms. Beasley believed was both preventable and the cause of more than a decade of life-changing medical problems.

Firm Cases Recognized as Top Florida Verdicts & Settlements for 2011
Matt Weissing and Brad Edward’s premises liability case was against Festival Fun Parks LLC Doing Business as Boomers. A young man with a promising football career was shot in the parking lot and sustained permanent nerve injury due to the property’s lack of security. Following a two-week trial, a Broward County jury returned a verdict in favor of the plaintiff for $4,255,280.00.
Gabriel F. Zambrano and co-counsel’s product liability case was against R.J. Reynolds Tobacco Company and Phillip Morris. They represented a widow whose husband was a smoker. The case alleged that the cigarettes caused the man’s fatal lunch cancer. A jury returned a verdict in favor of the plaintiff for $3,551,277.00.
Class Action Case Against CNA Receives Preliminary Approval
Our client’s class action case against CNA, for Attorney’s Steven Jaffe and Mark Fistosdiscrimination against Nurse Registries in FL, has received preliminary approval from Federal Judge Zlock.

Gary Farmer, Sr.’s 4th DCA opinion was quoted in The Atlantic regarding the Trayvon Martin shooting… Here’s how one Florida appellate judge, in a 2006 ruling, interpreted the low legal threshold necessary to move the burden of proof on self-defense from people like Zimmerman to prosecutors:
To repeat, the law did not require defendant to prove his justification of self-defense to any standard …measuring an assurance of truth. He did not have to prove the exigency of self-defense to a near certainty (reasonable doubt) or even to a mere probability (greater weight). His only burden was to offer additional facts from which it could be true, that his resort to such force could have been reasonable (emphasis in original). Once again Steffi and I (Steve Jaffe) have formed Team Lyndsay – Take Steps & Be Heard – Crohn’s & ColitisTeam Lindsay to walk in our annual Take Steps Walk on Saturday April 28, 2012. This year the Walk will be held in A NEW LOCATION at ArtsPark on Young Circle in Hollywood. Last year’s event drew more than 1,500 people and raised over $200,000. This year’s event promises to be a fun filled evening for the entire family.
As you all know our daughter Lindsay was diagnosed with Crohn’s disease when she was 15 years old. She has done remarkably well for herself despite the flair ups and hospitalizations that she has endured over the years. She became an accomplished scholarship athlete, playing soccer at Appalachian State University. She has graduated and is pursuing a career in Sports Administration. We are so proud of her. Unfortunately, others have not fared as well as Lindsay, nearly 1.5 million Americans, many who are children suffer from Crohn’s and Colitis and the number of people being diagnosed each year is increasing. The funds we raise through the Take Steps Walk will help support world class scientific research and sponsor educational programs and services for those afflicted with these diseases. Our hope is that others will be able to manage the disease as well as Lindsay has so far.

Former Employees of David Stern Agree to Settlement
Approximately 800 former employees of foreclosure attorney David J. Stern, who alleged that Stern and DJSP Enterprise did not give them 60 days notice as required by the Federal Worker Adjustment and Retraining Notification or WARN Act, have reached a preliminary settlement. Our firm and co-counsel Dawn Rapoport and Chandra Parker Doucette represent the named plaintiffs and class members. Attorney Steve Jaffe and Co-counsel Steven M. Dunn presented a $100,000 check to the Alzheimer’s Association, Southeast Chapter. The cy pres award (a court approved payment of settlement funds) was a result of a precedent setting long-term care insurance class action law suit – Ruderman v. Washington National Insurance Corporation.

Class Action Settlement Creates $8 Million Fund For Elderly Floridians
Judge James I. Cohn of the U. S. District Court for the Southern District of Florida has granted final approval of a class action settlement which creates an $8 million fund for elderly class members with home healthcare insurance policies issued by Washington National Insurance Company (WNIC). The agreement also places all those elderly insured’s back on claim, meaning the insurance company will now be responsible for the cost of care of our clients.
Attorneys Steven Jaffe and Mark Fistos also received court approval that required WNIC to make a $100,000 cy pres award (donation) to a charity whose mission is to serve the needs of the elderly — the court approved the Alzheimer Association as recipient of the donation.

Attorneys Gary Farmer, Mark Fistos, Seth Lehrman and co-counsel, who are representing former employees of the law firm of David J. Stern and a related company, have filed a federal class action lawsuit asking for back wages and benefits because they claim that hundreds of employees were fired without 60 days’ advance notice, as required under federal law.
The suit charges that Stern’s law firm and its publicly traded processing unit DJSP Enterprises didn’t follow the Worker Adjustment and Retraining Notification Act or WARN Act requirement to give employees 60 days’ warning — plus pay and benefits — before a mass layoff. Attorney Seth Lehrman prevailed in the firm’s prosecution of criminal forfeiture and restitution claims on behalf of thirty-seven former Rothstein Rosenfeldt Adler (“RRA”) clients who sought to recover more than one million dollars of settlement monies that had been deposited into a trust account of the RAA law firm prior to Scott Rothstein’s widely publicized theft of those monies. Attorney Gary Farmer drafted the winning brief in Geico Indemnity Co. v. Physicians Group, LLC, a/a/o Paul Androski, in which the Second District Court of Appeal confirmed on August 13, 2010, that the fee schedule amendments to the Florida Motor Vehicle No-Fault Law, § 627.736, Fla. Stat. (2008) (“PIP”) effective January 1, 2008, do not apply retroactively. The court’s ruling settles an issue which has been hotly contested in lower courts.

Farmer Named FJA Treasurer

Attorney Brad Edwards won a $735,000 jury verdict in a case brought on behalf of truck driver who lost three toes due to a warehouse accident.
Class Certification Upheld
The United States Court of Appeals for the Seventh Circuit issued an opinion upholding the trial court’s order certifying a multi-state class in Saltzman v. Pella, Case No. 06 C 4481, which is pending in the United States District Court for the Northern District of Illinois. Attorneys Steven Jaffe and Mark Fistos are handling the case.
Edwards Prevails on Key Rulings in Epstein Case
Attorney Brad Edwards succeeded in convincing a federal judge that billionaire Jeffrey Epstein must disclose specific figures showing his net worth. Brad also received a favorable ruling allowing his client access to a recording and transcript of a recording of a reporter’s off-the-record interview with Epstein. The reporter’s newspaper had sought to have the materials protected from disclosure based on a “qualified reporter’s privilege.” Brad is representing several young women in civil suits in which they allege Mr. Epstein sexually assaulted them when they were teens. Trial is set to begin July 14, 2010.
Lehrman Represents Football Great, Warren Sapp, and Others in Forfeiture Proceedings
Attorney Seth Lehrman has filed papers in forfeiture proceedings in bankruptcy court on half of Warren Sapp and others to recover monies they lost in trust funds held by Ponzi schemer, Scott Rothstein, which were never accounted for.
$520 million Whistleblower Recovery
Attorney Gary Farmer resolved a Whistleblower suit against pharmaceutical giant AstraZeneca, which will pay $520 million in civil fines and restitution to state and federal entities. The firm disseminated a press release on the case. The U.S. Attorney General issued remarks about the settlement. The federal Department of Justice also announced the settlement. Qui Tam Presentation
Firm attorney Gary Farmer was a presenter at the Florida Justice Association’s Workhorse Seminar in Orlando. He spoke on Qui Tam litigation, which has been the focus of much of his law practice. Qui Tam suits are also commonly known has whistleblower suits. Gary was one of the originating attorneys in the Qui Tam settlement involving Eli Lilly and the drug Zyprexa that resulted in a record $1.42 billion dollar settlement for illegal off-label marketing of drugs. Gary has handled notable class actions and other Qui Tam settlements.
Class Certification Granted in Long Term Health Insurance Case
The firm won a contested class certification ruling for the class action plaintiffs in one the firm’s long term health insurance cases, Ruderman, et al., v. Washington National Insurance Company filed in the United States District Court for the Southern District of Florida, Case No. 08-CV-23401-COHN/ROSENBAUM. Attorneys Steven Jaffe and Mark Fistos are representing the injured parties as Plaintiffs’ counsel in this class action case. The defendant’s petition to appeal the order was denied on March 4, 2010. The case has been stayed pending settlement discussions.

Attorney Steven Jaffe was appointed to the Board of Trustees of the Crohn’s and Colitis Foundation of America (Florida Chapter). Crohn’s and Colitis Foundation of America is a non-profit, volunteer-driven organization dedicated to finding the cure for Crohn’s disease and ulcerative colitis.

With their co-counsel, attorneys Steven Jaffe and Mark Fistos prevailed for the injured victims named as plaintiffs on a contested multistate class action certification motion pending in the United States District Court for the Northern District of Illinois, in the class action case Saltzman v. Pella, Case No. 06 C 4481.
NationsRent Administrative Fee Class Action Settled
With their co-counsel, firm attorneys Steven Jaffe and Mark Fistos won for the class action plaintiffs a contested nationwide class certification in In Re NationsRent Fee Litigation Case No. 06-60924-CIV-BROWN, filed in the United States District Court for the Southern District of Florida. A settlement has been reach for the class. The court entered an order finally approving the settlement on March 31, 2010.
Weissing Continues to Serve Foster Care Community
Attorney Matt Weissing continues to volunteer for 4Kids of South Florida, which provides Safe Place intake services for every dependent child which is taken into care in Broward County, serves children and those providing Foster Care, Adoption, Crisis Pregnancy, and provides stability for kids who are aging out of the foster care system. Matt and his family first became involved with the organization in 1996, when they accepted responsibility for a foster son.
Seeing the needs of foster children throughout our community, Matt became an advocate for foster children making numerous appearances on local radio stations, speaking before community organizations, in churches, etc. In 2008, 4Kids was recognized by the White House as the model for Foster Care in the United States.
