Personal Injury
By definition, “personal injury” is any harm or physical hurt caused to a person’s body, such as a broken bone, burn, poisoning, illness, cut, or a bruise. Personal injury may also include harm to someone’s emotional health. It can even include the tragic and life-altering wrongful death of a loved one.
Accidents and Mistakes, Illnesses and Crashes: So Many Causes of Injury
Automobile, car, truck, motorcycle, and boat accidents; helicopter or airplane crashes; construction site accidents; slip-and-falls; negligent security; medical, doctor, or healthcare provider mistakes and malpractice; nursing home neglect or abuse; school-related accidents and sporting event injuries; workplace or employment accidents or illnesses; and injuries and sicknesses from pollution, unsafe or defective products and drugs (both prescription and street drugs) are some of the circumstances that may led to a lawsuit for serious and sometimes fatal personal injuries.
After the Injury: Pain, Suffering, Money Damages and Financial Harm
The financial difficulties created by medical bills and lost wages resulting from personal injuries combined with the pain and suffering inflicted by the injuries can cause terrible problems and heartache for both injured victims and loved ones. When a loved one has died due to severe personal injuries caused by the wrongful acts of another, the grieving family also has to deal with the financial losses as a practical matter – including such things as funeral expenses and coping with the loss of a family breadwinner.
By filing a personal injury lawsuit, you and your family may be eligible to receive some relief for your problems. Personal injury lawsuits filed under Florida law or elsewhere can provide injured persons with “damages” defined by specific statutes and laws allowing for awards to victims and their families in the form of money for loss of income, bills, pain and suffering, emotional distress, and permanent disability. Additionally, the State of Florida, as well as other states, has a special law to provide for justice in the event of injuries that result in death, i.e., the Florida Wrongful Death Act.
There are Time Deadlines for Filing a Lawsuit for Personal Injury Claims in Florida
If you suffered a personal injury caused by another person you may only be able to bring a lawsuit only up until a given time period. There’s a deadline to file your case. States have passed laws called “statutes of limitations” which limit the time persons may bring certain types of lawsuits, including personal injury lawsuits. In Florida, there are several different laws that set time deadlines on lawsuits. General negligence injuries must be filed within 4 years, for example. Wrongful death cases have a specific Florida law that sets a time deadline of 2 years. Also, injuries based on doctor error or medical malpractice have special time frames for filing suit. Therefore, it’s very important to learn about your legal rights as soon as you or your loved ones are able to do so. If you miss the deadline, then your claim may be barred.
