Denial of Long Term Care Insurance
Our firm is currently investigating and litigating class actions and individual cases to help elderly individuals and their families protect their rights under long term care insurance policies, which provide critical care and coverage for insured individuals. Some of the areas we're reviewing include:
Annual Benefit Increase Provisions: The firm and its co-counsel are handling a certified class action in which the elderly plaintiff (through her children) alleges that an 8% annual increase should have been applied to all home health care benefits, including the Lifetime Maximum and Per Occurrence policy benefits. The defendant in the case is Washington National Insurance Company (successor to Pioneer Life Insurance Company). The Court has entered a stay pending settlement talks.
Assisted Living Facilities: Some home health care policies or insurance carriers allegedly attempt to exclude assisted living facilities from their definitions of "home" and deny coverage on that basis or on the basis that "home health care" cannot be provided on the premises of assisted living facilities or by employees of those facilities. Along these lines, we currently have pending investigations or individual cases involving several insurance companies, including Transamerica Life Insurance Company, American Pioneer Life Insurance Company, Bankers Life And Casualty Company, Guarantee Trust Life Insurance Company, Mutual Protective Insurance Company now known as Medico Insurance Company, Conseco Senior Health Insurance Company now known as Senior Health Insurance Company of Pennsylvania (SHIP).
