Homeowners’ Replacement Cost Insurance

"Replacement cost" as used in the insurance industry commonly refers to the amount needed to replace or repair damaged property with materials of similar kind and quality, without deducting for depreciation.

One case we're handling involves mobile homes which were destroyed by hurricanes. Defendants in the case include the Liberty American group of companies and their current or former parent entities, Philadelphia Consolidated Holding Corporation or Tokio Marine. The central allegation of the case is that the insurance policy on its face provides replacement cost coverage, but the defendants settled with homeowners on a policy limits basis. The defendants lost motions to dismiss and are appealing to a higher court. We're also investigating a company called "Pacific Specialty" for similar problems.
